written by We are bringing the latest Smart Update, regarding the amendments to the medical leave regime and health insurance indemnities.
Law no. 64/2026 approves, with amendments and additions, GEO no. 91/2025 and clarifies the application of the measure regarding the non-payment of the first day of medical leave. Key updates include:
▪️in the case of medical leave granted without interruption for the same illness episode or related complications, the indemnity reduction by one day will apply only once, regardless of the number of medical certificates issued. This eliminates the risk of withholding one unpaid day for each medical certificate issued for the continuation of the same medical condition;
▪️the indemnity reduction measure will NOT apply in the following cases:
– maternity medical leave;
– leave granted for the care of patients suffering from oncological conditions;
– maternal risk medical leave;
– leave granted to patients included in national health programs;
– medical leave granted during hospitalization;
▪️the new exceptions will apply to medical leave granted starting from 1 June 2026.
