Professional Training During the State of Emergency

As employers strive to align with the concept of telework, depending on the specifics of their activities and the ability to ensure continuity of all operational flows through this work method, adult professional training programs can also adapt to this trend and be conducted online.

Thus, according to Emergency Ordinance 32/2020, during the state of emergency, the theoretical training of adult professional training programs can take place online, provided that the authorization commission is notified in advance. Exceptions apply to qualification level 1 programs, where we generally refer to mandatory education or introductory professional programs, with professional training being acquired within vocational schools.

The notification to the authorization commission must be accompanied by proof of internet access and the availability of electronic devices for each individual trainee. This is done under the provisions of Article 30 of Government Ordinance 129/2000, submitted via email, and must include the following documents:

– Rental contracts or agreements for the provision of electronic devices, concluded by the authorized training provider with third parties, and a handover report for each device to each individual trainee;
– A self-declaration from each trainee stating that they have access to the internet and the necessary electronic devices for completing the theoretical training, signed and dated.

At the end of the state of emergency, the authorized training provider will be required to test all trainees to verify their understanding of the theoretical concepts covered in the online system.

During the state of emergency, the following documents can also be submitted electronically:

– Applications and authorization files for the training provider;
– Notification of changes in authorization conditions, accompanied by a self-declaration from the legal representative of the authorized training provider;
– The agreement of the authorization commission in case of notification of changes in authorization conditions;
– Notification and agreement for conducting training programs in a different county than the one in which the provider is authorized.

All received documents are analyzed by the commission members, including evaluation reports prepared by specialists, and a response regarding the granting or denial of authorization will be sent via email.

Additionally, during the state of emergency, the monitoring activities of authorized training providers and the examination of participants in professional training programs are suspended.

At the same time, depending on the decisions of the county emergency committees, the authorization commissions may decide to suspend the implementation of professional training programs.
