Important changes in the Labor Code regarding the minimum gross basic salary per country granted to romanian employees! According to the Emergency Ordinance no. 130/2021, regarding some fiscal-budgetary measures, the extension of some terms, as well as for the modification and completion of some normative acts, published in the Official Gazette, Part I no. 1202 of December 18, 2021, an employee can receive the minimum gross basic salary per country for a maximum period of 24 months from the conclusion of the individual employment contract. The changes entered into force starting with December 18.Â
We further present the main provisions of this normative act:
After paragraph 2 of Article 164 of the Labor Code, two new paragraphs are inserted:
(21) The minimum gross basic salary per country guaranteed in payment established under the conditions of par. (1) may be applied for an employee for a maximum period of 24 months from the conclusion of the individual employment contract. After the expiration of the respective period, during which the employee will be qualified or not, he will be employed with a basic salary higher than the minimum gross basic salary per country guaranteed in payment.
(22) The provisions of par. (21) also applies to the salaried employee with the minimum gross basic salary in the country guaranteed in payment, who has already concluded an individual employment contract with a duration of more than 24 months.
