The volunteering can be considered professional experience if the organizations specialized in working with volunteers meet certain obligations. The volunteering regulation in Romania is achieved, starting July 26, 2014, by Law 78/2014 which repeals Law 195/2001.
The volunteering is defined in the new law as mandatory public work, unpaid and based on free decision of individual volunteer by a legal person, public or private, non-profit, individually or in group.
The law 78/2014 brings as novelty, at article 10 (2), the regulation according to which volunteering is considered specialized professional experience, depending on the type of business, whether it is done in the field of study.
For the volunteering to be recognized as professional experience, the host organization (NGO) is required to prepare a voluntary contract, in writing, accompanied by a job description and a security document.
Terms of a volunteering contract
The law provides for the mandatory information that a voluntary agreement should contain:
- the contracting parties;
- the description of the activities that the volunteer is to provide;
- the time and the period of the voluntary activity;
- the rights and obligations of the parties;
- the professional requirements, social skills, development interests, health provision allowing activity, confirmed by health certificates or other documents;
- the conditions for terminating the contract;
- the regulations in case of unilateral termination.
The volunteer and host organization rights and obligations are summarized in the contract. If the volunteer request, the organization is obliged to conclude a contract of insurance against the risks of accident and sickness or other risks arising from the nature of the activity.
The organization working with volunteers has the obligation to have a register of volunteers, in which it is written:
- The activity duration;
- The type of activities;
- The volunteers evaluation results.
At the end of the volunteering, the organization issued, at the request of the volunteer, a competent certificate that contains:
- data about the organization;
- numbers and dates of issue of the certificate and the voluntary contract;
- firstname, surname and volunteer data;
- volunteering time;
- name and surname of the volunteer coordinator;
- name and surname of the legal representative of the host organization;
- mention “The volunteer and the issuing organization are responsible for the veracity of the data and information contained in this certificate”;
- volunteering roles undertaken and the types of skills acquired through volunteering.
