The GEO 158/2005 Amendment: New Disease Doesn’t Reduce the Sick Leave

The articles 34 and 40 of GEO 158/2005 on sick leave and medical allowances were amended by GEO no. 68/2014.

Thus, the duration of the sick leaves given for cardiovascular disseases does not diminish the total number of sick leave days granted for other conditions:

The duration of sick leave for tuberculosis, malignancies, AIDS, cardiovascular disease, pregnancy and confinement leave, sick child care, reducing labor time and quarantine, as well as maternal risk does not diminish the number of days of sick leave granted to an insured for other diseases .

The measure came into force on November 4, 2014.

The current legislation requires that the insured persons are entitled to the following types of medical leave:

  • sick leave and compensation for temporary disability caused by common diseases or accidents outside the workplace;
  • sick leave and compensation for illness prevention and recovery work capacity, exclusively for situations arising as a result of work accidents or occupational diseases;
  • sick leave and maternity allowance;
  • sick leave and sick child care allowance;
  • sick leave and maternity risk allowance.

The duration of any of this type of leave is subject to the payment of health insurance contributions for the support of the aforesaid indemnities, called leave and allowance contribution.

Article 40, paragraph (1) is amended as follows: (1) The allowances may be required based on supporting documents, within 90 days from the date on which the persons mentioned in art. 1, para. (2), art. 32 para. (1), and also the payers stipulated in art. 36 para. (3) a) and b) were entitled to ask them.

Since this article was initially applicable for the medical allowance “beneficiaries” only, in practice there have been discussions on health houses that these beneficiaries can be assured only individuals, not employers.
