Government Decision no. 855/2013, approving the Methodological Norms for applying Law no. 279/2005 on apprenticeship work, introduces new regulations regarding apprenticeship contract and introduces a new model of contract.
The legal document was published in Official Monitor no. 705 of 18 November 2013.
Government Regulations 855/2013 refers to:
- A new model of apprenticeship contract
- Repealing GD 234/2006, the old rules for the application of the rules on apprenticeships
- Change in the way information NEA by employers who have vacancies for apprentices.
What the contract of apprenticeship contains
In addition to the specific elements of any individual contract of employment, apprenticeship contract contains special provisions:
- The name of the qualification that will be gained by the apprentice, qualification included in the National Register of professional qualifications in Romania
- The name of training provider performing apprenticeship program at work
- The name and qualifications of the apprenticeship coordinator
- Vocational training venue
- The duration necessary theoretical and practical training through apprenticeship
- Additional duties and obligations of the employer’s apprentice
- Other clauses
The duration of the theoretical and practical training through apprenticeship is expressed in hours per levels of qualification:
- 360 hours for qualification level 1
- 720 hours for qualification level 2
- 1080 hours for qualification level 3
The employer’s obligations under the new provisions include:
- Ensuring all appropriate rights and practical training to qualify for the apprentice with a fixed-term labor contract
- Providing access to educational background in user training program completed professional qualification certificates, under GO 129/2000
- Establishment of a service contract training with authorized third party, given the aforementioned Ordinance
- Supporting value of the apprentice training program.
The writing apprenticeship contract is highlighted in the register of the employees with the statement “CU”.
What elements should be submitted to NEA
The employers seeking apprenticeship signing contracts with various employees must communicate a completed form to the NEA in whose jurisdiction they are established. The form includes the following elements:
- Under “occupation name” add the phrase “CU” (apprenticeship contract)
- Complete code for COR 6 characters that ends the occupation for apprenticeship
- The “period of employment” will be completing the apprenticeship contract duration depending on the level of qualifications (Article 9 of Law 179/2013)
