Amendments to Law no. 283/2024 introduce a clear mechanism for setting and updating the gross minimum wage at the national level, in accordance with EU Directive 2022/2041. This mechanism involves consultation with trade unions and employer confederations, and the guaranteed gross minimum wage will be updated annually by government decision.
Among the key changes there are strict rules for employers, who are required to guarantee a gross monthly salary at least equal to the minimum wage set by government decision. Additionally, the gross minimum wage can be applied to an employee for a maximum of 24 months, after which it must be increased. Failure to comply with these provisions will result in fines ranging from 3,000 to 5,000 RON per employee, without exceeding a total of 200,000 RON.
A special attention is also given to situations where employment relationships are not based on an individual employment contract. In such cases, the employer is obligated to ensure remuneration at least equal to the hourly gross minimum wage established by legislation or collective agreement. Furthermore, it is stipulated that parties in legal disputes over employment may include those involved in relationships not based on an individual employment contract.
